General Terms and Conditions (GTC) for betterRelations GmbH
§ 1 Scope
1. These General Terms and Conditions (GTC) apply to all business relationships between betterRelations GmbH (Seller), represented by the managing directors Simon Papasabbas and Nina Peis, Choriner Str. 6, 10119 Berlin, and its customers. They cover the operation of the online shop.
2. The Seller reserves the right to amend these GTC at any time. The current version is available on the Seller’s website.
§ 2 Service Description
The Seller operates an online shop selling its own products, particularly the card game “Playdate for Two.”
The following characteristics define the contractual condition of the purchased goods:

• Slide box
• Game instructions
§ 3 Conclusion of Contract
By clicking the confirmation button in the online shop, the customer submits a binding offer to conclude a purchase contract. The Seller confirms receipt of the order via email. The purchase contract is concluded upon the Seller’s email order confirmation immediately after receiving the order.
§ 4 Right of Withdrawal
The customer has a statutory right of withdrawal if they are a consumer. Further details on the withdrawal process are outlined in Appendix 1.
§ 5 Retention of Ownership
The purchased product remains the property of the Seller until full payment is received.
§ 6 Prices and Shipping Costs
Prices listed on the website include statutory VAT and other price components (e.g., delivery).
§ 7 Delivery
1. Delivery is available within Germany and the EU.
2. The delivery time is approximately 5 working days. Deviations in delivery times are indicated on the website.
If the buyer requests a different shipping method, they bear any additional costs, which are payable even in the event of withdrawal. When the buyer selects and commissions the carrier, the risk of accidental loss and deterioration transfers to the buyer upon handover to the carrier.
§ 8 Payment Terms and Default
1. The purchase price is due upon conclusion of the contract.
2. Payments are made according to the methods specified during the ordering process.
3. If payment is not received within one week of the contract’s conclusion, the Seller sends a payment reminder. After two weeks of non-payment, a formal reminder with reference to default interest and reminder fees is issued, including information about potential legal proceedings.
§ 9 Warranty
1. The customer’s warranty rights follow statutory provisions unless otherwise stated. Liability claims against the Seller are addressed in § 10 of these GTC.
2. The warranty period for consumers is two years for new products and one year for used products. For businesses, the warranty period is one year for both new and used products.
Exceptions to shortened warranty periods include claims for damages due to injury to life, body, or health, or significant contractual obligations. These obligations are essential for achieving the contract’s purpose and ensure defect-free goods.
The shortened warranty does not apply to claims arising from intentional or grossly negligent breaches of duty by the Seller, its representatives, or agents.
§ 10 Liability
1. Claims for damages by the customer are excluded unless otherwise specified. This exclusion also applies to legal representatives and agents.
2. This applies to all claims for damages, regardless of their legal basis, including product defects or breaches of duty.
3. Exceptions include claims for damages due to injury to life, body, or health, or breaches of significant contractual obligations. It also excludes cases of gross negligence or intent by the Seller or its representatives.
4. Liability under the German Product Liability Act remains unaffected.
5. The Seller assumes no responsibility for products or services from third parties.
§ 11 Governing Law, Jurisdiction, and Contract Language
1. German law applies, except for mandatory consumer protection provisions in the customer’s country of residence.
2. For business customers, the place of jurisdiction is the Seller’s registered office in Berlin.
3. The contract language is German.
§ 12 Severability Clause
Should any provision of these GTC be or become invalid, the remaining provisions shall remain unaffected.
Appendix 1: Right of Withdrawal
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period for purchases in the online shop is fourteen days from the day you, or a third party named by you who is not the carrier, takes possession of the last goods.
The withdrawal period for chartering passenger ships, boats, kayaks, and for manual services or facility management is fourteen days from the date of contract conclusion.

via a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the provided sample withdrawal form, but it is not mandatory. If you use this option, we will send you confirmation of receipt of the withdrawal without delay (e.g., by email).
To meet the withdrawal deadline, it is sufficient for you to send the notification of exercising the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for additional costs arising if you chose a delivery method other than the least expensive standard delivery offered by us) promptly and no later than fourteen days from the date we receive notification of your withdrawal.
For reimbursement, we use the same payment method you used for the original transaction unless explicitly agreed otherwise; in no case will you incur fees for this reimbursement.
You must return the goods promptly, in any case no later than fourteen days from the date you notify us of the withdrawal, to:

The deadline is met if you send the goods before the fourteen-day period expires.
You bear the direct costs of returning the goods. We may withhold reimbursement until we have received the goods back or until you have provided evidence of returning the goods, whichever is earlier.
